Terms of service

These terms are the agreement between you and Rafael Ortiz, an individual doing business as Tresi in the United States ("Tresi", "we", "us"). By creating an account or using the app, you agree to them. If you do not, please do not use Tresi.
The short version. Tresi shows you your own spending and can never move your money. The numbers come from your bank, so treat them as a helpful summary rather than an official statement. A subscription renews until you cancel, and you cancel it wherever you bought it. You can delete everything at any time.
1. Who can use Tresi
You must be at least 18 years old and legally able to enter into this agreement. You may only connect financial accounts that belong to you or that you are authorised to access. You are responsible for everything that happens under your account, so keep access to your email address secure, since that is how signing in works.
2. What the service is
Tresi reads transactions and balances from financial accounts you connect, sorts them into categories, matches receipts you photograph to the charges that paid for them, and tracks the budgets and funds you set. There is also an offline mode with no account and no server, where you enter transactions yourself and nothing is uploaded anywhere.
Tresi is read-only. It cannot initiate a payment, transfer funds, freeze a card, or take any other action on a connected account, and we will not add the ability to do so without telling you first.
3. Bank connections and Plaid
Tresi connects to your financial institutions through Plaid Inc. You enter your bank credentials on Plaid's own hosted page, never inside Tresi, and we never see or store them. By connecting an account you agree to Plaid's End User Privacy Policy and you authorise Plaid to share your transaction and balance data with us so that we can provide the service.
Plaid is a third party. We do not control whether a particular institution is supported, how quickly it delivers data, or whether a connection breaks and needs to be relinked. You can disconnect any institution from inside the app at any time, which revokes our access to it.
4. Accuracy, and what not to rely on this for
The transaction and balance data in Tresi comes from your financial institutions by way of Plaid. It can be delayed, incomplete, duplicated, or simply wrong at the source, and pending transactions routinely change after they settle. Categories are assigned automatically and will sometimes be wrong until you correct them.
Your bank's own statement is the authoritative record, not Tresi. Do not rely on Tresi for tax filing, lending decisions, legal proceedings, or anything else where being wrong is expensive.
Tresi is not a bank, a money transmitter, a broker, or a financial adviser, and nothing in the app is financial, tax, investment or legal advice.
5. Subscriptions and billing
Some features require a paid subscription. The price, the billing period, and anything included in a free trial are shown to you before you buy, at the point of purchase. By subscribing you authorise a recurring charge for the plan you chose.
- Automatic renewal. Subscriptions renew automatically at the end of each billing period at the then current price, until you cancel. Cancelling stops the next renewal. It does not shorten the period you already paid for, and you keep access until that period ends.
- How to cancel. If you subscribed through the Apple App Store or Google Play, manage or cancel the subscription in your Apple or Google account settings, because those stores control billing and we cannot cancel it for you. If you subscribed directly through us, cancel in the app under Settings, or email us.
- Free trials. Where a free trial is offered, it converts into a paid subscription at the end of the trial unless you cancel before then. Cancel at least 24 hours before it ends if you bought through an app store, since that is the window those stores enforce.
- Refunds. Purchases made through the App Store or Google Play are refunded by Apple or Google under their policies, and we have no ability to issue those refunds ourselves. For purchases made directly through us, payments are non refundable except where required by law, though if something went genuinely wrong then email us and we will sort it out.
- Price changes. We will give you at least 30 days notice before a price change affects your renewal, and you can cancel before it takes effect.
- Taxes. Prices exclude taxes unless stated otherwise. You are responsible for any tax that applies to your purchase.
- Failed payment. If a payment fails we may suspend paid features until it succeeds. Your data is not deleted because of a failed payment.
6. What you agree not to do
- Connect accounts you are not authorised to access.
- Attempt to break, overload, probe or reverse engineer the service, or to reach data that is not yours.
- Use the service to break the law, or to launder, conceal or facilitate anything illegal.
- Resell, sublicense or scrape the service, or use it to build a competing dataset.
- Upload anything containing malware, or anything you have no right to upload.
7. Your data stays yours
Everything you put into Tresi, and everything we retrieve on your behalf, remains yours. You give us only the permission we need in order to run the service for you: to store your data, process it, categorise it, and show it back to you. We do not claim ownership of it, and we do not use it to advertise to you or to anyone else. How it is handled is described in the privacy policy, which is part of this agreement.
Tresi itself, including the app, the software and the bunny, stays ours. These terms do not transfer any of our intellectual property to you beyond the right to use the app.
8. Availability and changes
We aim to keep Tresi running and working, but it is provided as is and we do not promise uninterrupted service. We may add, change or remove features. If we remove something significant, or discontinue the service entirely, we will give you reasonable notice and time to export your data.
9. Ending the agreement
You can stop at any time by deleting your account in the app, which is described on the account deletion page. Deletion is immediate and irreversible, with no recovery window, so export anything you want to keep first.
We may suspend or terminate your account if you materially breach these terms, if we are legally required to, or if keeping your account open would create a security risk for you or others. Except where the law or a serious security problem prevents it, we will tell you why.
10. Disclaimer of warranties
To the fullest extent permitted by law, Tresi is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranty of merchantability, fitness for a particular purpose, accuracy, or non infringement. We do not warrant that the service will be uninterrupted, secure, error free, or that the data shown will be accurate or complete. Some jurisdictions do not allow these exclusions, in which case they do not apply to you.
11. Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost savings, overdraft or late fees, missed payments, or decisions you made based on information shown in the app. Our total liability for any claim relating to Tresi is limited to the greater of the amount you paid us in the twelve months before the claim arose, or fifty United States dollars.
Nothing in these terms limits liability that cannot be limited by law, including liability for fraud, or for death or personal injury caused by negligence.
12. Indemnity
You agree to indemnify and hold us harmless from claims, losses and reasonable legal costs arising out of your misuse of the service, your breach of these terms, or your connection of an account you were not authorised to access.
13. If you installed Tresi from an app store
This agreement is between you and us, not between you and Apple or Google. They are not responsible for Tresi, for supporting it, or for any claim you have about it, and they have no obligation to provide maintenance or support. Apple and Google are third party beneficiaries of these terms and may enforce them against you. Your use of the app must also comply with the applicable app store's own terms of service.
14. Changes to these terms
We may update these terms. For anything material we will give you notice in the app before the change takes effect, and continuing to use Tresi afterwards means you accept the updated terms. If you do not accept them, delete your account.
15. Governing law and disputes
These terms are governed by the laws of the State of New York, United States, without regard to its conflict of law rules. Any dispute will be brought in the state or federal courts located in Monroe County, New York, and both of us consent to that jurisdiction. If you are a consumer in a country whose law gives you the right to bring proceedings locally, this does not take that right away from you.
Before filing anything, please email us. Almost everything is faster to fix that way.
16. Odds and ends
If any part of these terms is found unenforceable, the rest still applies. Not enforcing a term once does not waive it. You may not assign this agreement, and we may assign it to a successor if Tresi is transferred. These terms, together with the privacy policy, are the entire agreement between us about Tresi.
